Class Description:
Common Law – Structures is an excellent class for the student seeking a generalized summary of the common law, both historically and in modern application. The class is expected to cover the following subjects:

  1. The Paradise Torah – a summary and discussion of the instructions given before Mosheh.
  2. The Eben Rosh Pinna – a discussion of the Ten Devariym as the foundation of the law; the stone of stumbling and the rock of offense.
  3. The Covenant of the Ten Devariym – a discussion of the Ten Devariym and the foundation of all human rights and their significance to modernity.
  4. Criminal Law – a discussion of the foundation of the criminal law: the proscription of behavior; the manifestation of intent; the finding of culpability; and the sanctions.
  5. The Law of Negligence – a discussion of the violation of the proscription of behavior through negligence; the finding of culpability and negligence; and the sanctions.
  6. Contract Law – a discussion of the foundations of contract law: mutual assent; agreement; subject definition; the necessity of a writing in real estate; the obligations of affirmation.
  7. The Law of Dowry – a discussion of the marital apparatus surrounding the dowry and the inheritance of a woman in scripture.
  8. The Law of Primogeniture – a discussion of the transfer of ownership between generations and the position of the primogeniture.
  9. The Law of Torts – a discussion of the foundation of the law respecting the destruction of another’s property or property interest: the proscription of behavior; the manifestation of intent; the finding of culpability; and the sanctions.
  10. The Law of Bailments and Transactions – a discussion of the foundation of the law regarding bailments and transactions and its relevance to the modern world of international trade.
  11. The Common Law in Practice – the three premises of the common law; the qualifications of a judge, a king, or a lawmaker; the supremacy of the common law in governing a society; Conclusions.
